The Establishment of the Investment and Commerce Court in Qatar

HH the Emir Sheikh Tamim bin Hamad al-Thani issued Law No. 21 of 2021 regarding the establishment of the Investment and Commerce Court which has been implemented on May 10, 2022. This law has been issued in order to establish a competent court to consider cases and disputes related to trade, commercial matters and investments, such as disputes results from commercial contracts, e-commerce, unfair competition and intellectual property rights.

The purpose of this law is to simplify and expedite commercial procedures and disputes that usually require speedy settlement, as it can be difficult sometimes for the ordinary judiciary to resolve such disputes as quickly as they should be for a variety of reasons, including the large number of cases considered by competent courts and a lack of judges.

This law consists of 35 articles regulating issues and procedures before the Investment and Trade Court, and it is notable for the short timeframes associated with litigation procedures and the consideration of cases and appeals, as commercial disputes necessitate prompt resolution. In addition, this law established an electronic system under which any action regarding any dispute will be taken electronically.

As a conclusion, the issuance of this law and the establishment of the Investment and Trade Court would give Qatar’s economy a boost and help it attract many international investments.
